Deadlines for complying with the new occupational risk prevention obligations for domestic workers
The main obligations are to carry out a risk assessment (with the corresponding actions to implement the protective measures derived from this assessment), to train staff, and to provide medical check-ups.
The entry into force of the RD is 12 September 2024, although in the fifth final provision it establishes that the obligations established for the employer will not be enforceable until 6 months after the INSST develops and makes available the risk assessment tool described in the RD. And let's remember that the INSST has up to 10 months to do so, according to the RD itself.Staff must have the training in prevention established in the RD from the date required to have the risk assessment, provided that the SEPE has developed the way to carry out the course.The obligation of health surveillance is pending the development of the regulatory provisions relating to medical check-ups within the framework of the National Health System, with no established maximum dates.
